Terms of Service

VitalSaver is a free educational simulator. It is not a medical device and must never be used to care for a real patient.

1. Educational purpose only

VitalSaver is designed strictly for educational and simulation training purposes only. It is NOT intended to be used for clinical decision-making, diagnosis, treatment, or direct patient care.

It is not a medical device, and it has not been reviewed, cleared, or approved by the U.S. Food and Drug Administration or by any other regulatory authority. Nothing in this application is intended to diagnose, treat, cure, or prevent any disease or condition.

It does not provide continuing education (CE or CME) credit and confers no certification, license, or credential of any kind.

2. No professional relationship and no clinical reliance

Using this application does not create a physician-patient relationship, a clinical supervisory relationship, or any professional relationship between you and the developer.

Drug doses, package-insert summaries, physiologic responses, timings, and scoring are deliberately simplified for teaching. They are not a substitute for the current FDA prescribing information, the current guidelines of your professional body, your institution's protocols, or your own clinical judgment.

If you are facing a real emergency, call 911 or activate your institution's emergency response system immediately. Do not consult this application.

3. Who may use it

The application is intended for anesthesia professionals, clinicians, and students in the health professions. You are responsible for ensuring that your use complies with the rules of your employer, training program, and licensing body.

It is not directed to children, and it is not intended for use by patients or the general public to make decisions about their own care.

4. Intellectual property

The application, its source code, scenario content, clinical explanations, artwork, and the VitalSaver name are owned by Haruto Fujita, MD and FJ Anes Consulting, and are protected by copyright and other applicable laws.

You may use the application for your own learning and for teaching in your institution. You may not sell it, sublicense it, present it as your own, or incorporate its content into a commercial product without written permission.

Guidelines, prescribing information, and other third-party materials referenced in the application remain the property of their respective owners. The application links to them; it does not reproduce them verbatim, and it is not endorsed by or affiliated with any of those organizations.

5. Voluntary support

All features of the application are free. There is no subscription, no paywall, and no feature that must be purchased.

If you choose to make a voluntary support payment, it is a contribution toward running costs, not the purchase of a product, a licence, or a service level. It gives you no additional functionality and creates no obligation on the developer to provide, maintain, or continue the application.

Payments are processed by Stripe on Stripe's own pages. See the Refund and Cancellation Policy for how contributions are handled.

6. No warranty

The application is provided "as is" and "as available", without warranty of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

Clinical content is based on publicly available guidelines at the time of writing. Guidelines change, and errors are possible. The developer does not warrant that the content is current, complete, or free from error.

The developer does not warrant that the application will be available without interruption or that defects will be corrected.

7. Limitation of liability

To the maximum extent permitted by applicable law, the developer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or clinical outcome, arising out of or in connection with your use of, or inability to use, the application.

To the maximum extent permitted by applicable law, the developer's total aggregate liability arising out of or relating to the application shall not exceed the total amount you have paid to the developer in the twelve months preceding the event giving rise to the claim, or USD 100, whichever is lower.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain liabilities. In those jurisdictions, the exclusions and limitations above apply only to the extent permitted.

8. Changes to the application and to these terms

The developer may modify, suspend, or discontinue the application, in whole or in part, at any time and without notice.

These terms may be updated. The date at the top of this page indicates when they were last changed. Continuing to use the application after a change constitutes acceptance of the updated terms.

9. Governing law and jurisdiction

These terms, and any dispute or claim arising out of or in connection with them or with your use of the application, are governed by the laws of Japan, without regard to conflict of law provisions.

You and the developer agree that the Tokyo District Court shall have exclusive jurisdiction of the first instance over any such dispute or claim.
